How Canadian County Divorce Filings Work

Divorce cases in Canadian County are filed at the Court Clerk's Office. Oklahoma is a non-form state. The Canadian County Court Clerk does not supply divorce papers, petitions, or full filing packets. Papers must come from an attorney or legal service. The only divorce documents the clerk provides locally are the summons and the Entry of Appearance Waiver, and both must be completed in blue or black ink.

The respondent cannot sign the waiver until at least 24 hours after the petitioner files the petition. That timing rule is firm. The clerk will issue the summons upon filing; service may be by process server, sheriff, or certified mail.

Divorce is filed under the Family and Domestic (FD) case-type code in OSCN. Paternity, legal separation, and annulment cases run through the same division. Each has its own fee, though divorce with and without minor children cost the same amount.

The Canadian County Court Clerk divorce page posts the domestic filing fees and explains the non-form-state rules. The screenshot below shows that page as captured from the official county site.

The fee schedule on that page covers all domestic case types the Court Clerk processes, from paternity filings to annulments. The summons fee is separate and carries an additional service cost on top of the flat $10.00 charge.

Canadian County Divorce and Family Filing Fees

The Court Clerk publishes a complete fee list for domestic and family filings. All fees below are from the official Canadian County divorce page and cover the initial filing cost only. Service costs and attorney fees are separate.

Filing TypeFee
Paternity with custody$255.89
Paternity without custody$162.89
Divorce and paternity foreign judgment$157.89
Divorce with minor children$255.89
Divorce without minor children$255.89
Legal separation$255.89
Annulment$255.89
Summons$10.00 plus service

Divorce with minor children and without minor children both cost $255.89. The difference is procedural: minor-child cases require a parenting class from both parents. The summons fee of $10.00 applies when the clerk issues a summons; service costs are separate. Legal separation and annulment also run $255.89 each.

Divorce Filing Steps in Canadian County

Filing for divorce in Canadian County follows a set sequence. The Court Clerk's divorce page and the county's filing guide are the source for the steps below.

  1. Prepare the petition and required documents through an attorney or legal service. The Court Clerk does not supply divorce forms.
  2. Bring one original and two copies to the Canadian County Court Clerk, 301 N Choctaw Avenue, El Reno, OK 73036.
  3. Pay the filing fee ($255.89 for divorce with or without minor children). No transactions after 4:15 p.m.
  4. The clerk issues the summons. Print and complete it in blue or black ink, then return it to the Court Clerk's Office.
  5. Serve the respondent by process server, sheriff, or certified mail.
  6. If the respondent signs the waiver instead, wait at least 24 hours after the petition is filed before signing. Signing early is not allowed.
  7. If minor children are involved, both parents must complete a parenting class before the court enters a final decree.
  8. Monitor the case on OSCN using the Family and Domestic (FD) case-type filter for Canadian County District Court.

Important: Oklahoma is a non-form state. The Court Clerk does not hand out divorce petitions or full filing packets. Obtain forms through an attorney or legal service before coming to the office.

Parenting Class Requirement for Canadian County Divorces

When a Canadian County divorce involves minor children, both parents must attend and complete a parenting class. It is not optional, and it applies to both parties. The Court Clerk's divorce page states this plainly.

Divorces without children, legal separations, and annulments do not carry this requirement. Courts use the class to address co-parenting communication and the effect of separation on children. Completion must typically be documented in the court file before a final decree is entered. The county page does not name an approved provider; check with the Court Clerk or assigned judge after filing.
